Title Searches

Once there is a sales contract, and you partner with our firm for residential title services, we quickly get to work on your behalf. Our team conducts an in-depth search of all relevant public records, including mortgages, deeds, liens, paving assessments, divorce settlements, wills, and other documents affecting the title to the property.

Fortunately, technology has made this process more streamlined than in the past. However, we may make some trips down to the local courthouse to secure the records we need on your behalf. Typically, newer homes have fewer documents to search for than older ones.

Title Examinations

When you purchase a residential property, you assume that the seller is entitled to make a legal transfer. Title examination involves the process of going through all records obtained during the title search to ensure there isn’t anyone else with a claim or lien on the property that is going to materialize at some point in the future.

Things like unpaid association fees, contractor’s bills, or property taxes can show up in this search. If they do, they will need to be resolved before closing to produce a clear title.

Title Insurance

Even with a thorough title search and examination, there may be unknown encumbrances, liens, or other defects that do not materialize prior to closing. Examples include undetected fraud or forgery on a prior deed or an unknown heir who comes forward to make a claim. If a claim were made after you closed on the property, it could cost thousands to defend the claim, and you could still lose your property. This is why we recommend title insurance.

Title insurance, which is required by most mortgage lenders, protects you in the event any title claim arises on your property in the future. Title insurance is paid at the time of closing with a one-time, affordable premium that is based on the sales price of the home. Escrow Services

When you use a trusted escrow service, your funds are held in a secure account until the transaction is finalized. If any conditions are not met during the process, the funds are returned to the buyer. Most mortgage lenders require the use of escrow to eliminate various risks, such as a homeowner refusing to pay property taxes. Residential Closing

Also known as settlement, our services will ensure that all parties have adhered to the terms of the purchase agreement. A voluntary lien is a claim over the property that A voluntary lien is a claim over the property that a homeowner agrees to give to a creditor as security for the payment of a debt.

A mortgage lien is the most common type of voluntary real estate lien, also called a deed of trust lien in some states. Anyone who has financed their home with a mortgage loan would automatically have this type of lien applied to their property. 

An involuntary lien can be placed on a property regardless of whether the owner wants it on their property. In other words, an owner’s property can be claimed against their will if payments aren’t made in a specified time period. These types of liens are more dangerous because borrowers can be unaware that the liens have been placed against them. 

Any party that homeowners are obligated to abide by for payment can file an involuntary lien against the property. These include but are not limited to: Contractors, Property Tax Collectors, Utility Departments (i.e., code, permit, sewer, and water).

An escalation clause is designed to edge out compe An escalation clause is designed to edge out competing bids by automatically raising an offer when a competing bid comes in, almost like setting your maximum bid on eBay. An escalation clause is usually only recommended in situations where there will likely be multiple competing offers. 

The clause is triggered by a competing offer from another potential buyer. When that competing bid is made, the escalation clause automatically increases its own offer by a preset amount. It is important to  set an upper limit on how much you're willing to pay. Otherwise, your bid will keep getting incrementally higher and you could wind up being on the hook for a final price that's way over your budget. It provides the unpaid party a legal claim to a portion of your property when it's sold, and you typically can't sell your property until the lien is cleared. The most common liens are:

Mechanics Liens: Results when the homeowner hires a contractor to perform home improvements, and fails to pay them for their services.

 Tax Liens: Filed due to unpaid taxes and can include local property taxes, and missed federal tax payments (Lien filed by IRS).

 Judgment Liens: Result from court cases in which it was ruled that you owe money to another party. Examples include unpaid credit card debt, medical bills and child support.
